Arrest Warrants

An arrest warrant is issued when a judge finds probable cause to believe a person committed a crime, based on evidence or testimony submitted by law enforcement. Once issued, it authorizes officers to take that person into custody at any location. Waiting doesn’t make an arrest warrant go away.

Bench Warrants

A bench warrant is issued directly by a judge, most often after a failure to appear in court, a probation violation, or noncompliance with a court order. Under California Penal Code sections 1320 and 1320.5, failure to appear can itself become a separate criminal charge.
