Parole Is Not Probation
The two terms get used interchangeably, but they describe different situations with different supervising authorities and different legal procedures. Probation is a court-ordered alternative to incarceration. Parole is conditional release from state prison, allowing an eligible person to serve the remainder of their sentence in the community under supervision rather than behind bars.
In California, parolees are supervised by the California Department of Corrections and Rehabilitation through its Division of Adult Parole Operations. Under California Penal Code Section 3000.08, parolees convicted of serious felonies, violent felonies, Three Strikes offenses, and certain other specified crimes fall under the jurisdiction of the superior court in the county where the parolee resides or where the alleged violation occurred. For parolees living in Ventura County, that court is Ventura County Superior Court. Parole terms average approximately three years, though some extend to five years or longer depending on the underlying offense.
Common parole conditions include regular check-ins with a parole agent, drug testing, travel restrictions within designated county limits, compliance with all state laws, and registration requirements for certain offenses.
What Triggers a Parole Violation Allegation
Violations fall into two categories. The first is new criminal conduct: a parolee can be alleged to have violated parole by committing a new crime, even without a conviction. The second is technical violations, which don’t involve new crimes but still breach the conditions of release.
Common technical violations include:
- Failing to report to a parole agent
- Testing positive for drugs or alcohol
- Traveling outside approved county limits without permission
- Possessing prohibited items
- Failing to comply with registration requirements
After a parole hold is placed, the parolee is held in county jail while awaiting the hearing. Revocation proceedings can be initiated even when no new criminal charge is filed, provided there is sufficient evidence of a violation.
The Parole Revocation Hearing Process in Ventura County
Parole revocation hearings are held in Ventura County Superior Court under California Penal Code Section 3000.08. The standard of proof is preponderance of the evidence, meaning the court must find it more likely than not that a violation occurred. That’s a lower bar than the beyond-a-reasonable-doubt standard applied in criminal trials, which is one reason early, strategic preparation carries so much weight in these proceedings.
Rights at the Hearing
The parolee has the right to legal representation, written notice of the alleged violations before the hearing, the opportunity to present evidence, the right to call witnesses, and the right to cross-examine the parole agent and other witnesses.
Possible Outcomes
If revocation is found, sanctions range from additional conditions on release up to a maximum of one year of reincarceration under California Penal Code Section 3057. When the violation involves new criminal conduct, the district attorney may also file separate criminal charges. A parolee who prevails at the hearing remains on parole and must complete the remaining parole term.
Attorney Welch’s Approach to Parole Revocation Defense
Attorney Welch reviews the evidence supporting the alleged violation, identifies procedural and factual weaknesses in the government’s case, and builds a strategy before critical deadlines pass. Retaining counsel early allows for intervention before the hearing is set, which may change the trajectory of a case.
Defense strategies in revocation proceedings may include challenging the evidence underlying the alleged violation, presenting mitigating circumstances, demonstrating consistent compliance with other parole conditions, or negotiating with the parole agent or prosecutor for modified conditions rather than full revocation. Attorney Welch is a board member of the Ventura County Criminal Defense Bar Association and has secured hundreds of case dismissals in Ventura County, including in cases where the facts were difficult at the outset.
Consequences Beyond the Revocation Hearing
Reincarceration following revocation disrupts employment, housing, and family obligations in ways that often outlast the custody period itself. For non-citizens, a parole violation that results in a new criminal conviction or extended sentence can carry immigration consequences separate from the revocation outcome. A revocation finding may also affect future eligibility to seek expungement of the underlying conviction. These downstream effects make the hearing worth contesting, rather than accepting as inevitable.
